AUSTIN — ROUND ROCK, Texas -- The 18-year-old son of McNeil High School's head football coach and a 17-year-old have been indicted for allegedly recording a student in the northwest Austin high school bathroom in November, according to documents obtained by KVUE.
A representative with Round Rock Independent School District told KVUE the recording was posted on Snapchat.
According to the indictments for Cory McMahan -- the son of the school's athletic coordinator and head football coach -- and Corbin Banda, 17, both face a charge of invasive visual recording. The indictments allege that the two teens "recorded the intimate area of the complainant while the complainant was in a stall in a restroom located at McNeil High School." The indictments state that the person who was recorded had a reasonable expectation that the intimate area was not in public view.
“Basically if you cover it up with a bra or underwear, and it's in one of those places, then it's presumed that you intend to violate that law,” said George Lobb, an attorney in Austin.
McMahan and Banda were sent to alternative placement for 30 days, a school representative told KVUE. They have now returned to the school, the representative said.
RRISD spokesperson Jenny LaCoste-Caputo released the following statement Monday:
The incident that occurred was a gross violation of privacy and behavior that will not be tolerated in Round Rock ISD. It was immediately investigated and reported to law enforcement as soon as McNeil High School administrators were made aware and both students involved received disciplinary consequences. While technology has transformed the way we deliver education in many positive ways, it also has opened the door to numerous negative behaviors and outcomes. In Round Rock ISD we will continue to be vigilant when it comes to teaching and policing digital citizenship, reporting violations to the police, when appropriate, and holding our students accountable for their behavior. We also provide curriculum on social media to all of our campuses and provide instruction on issues like acceptable use, digital safety, cyber bulling and digital/information literacy. Staying safe online and using proper online etiquette is interwoven throughout our Digital Citizenship Curriculum. We hope our parents will help reinforce these messages and help us keep their children from making a mistake that could have devastating effects on their lives and the lives of others.
