Warrant issued for dump truck driver who allegedly pointed gun at another employee

AUSTIN — A warrant has been issued for the arrest of a dump truck driver who allegedly pulled a handgun on a woman at a construction site on Friday, Jan. 19, 2018, according to an arrest affidavit.

Marco Antonio Machado-Medina was accused of allegedly pointing the firearm at Magdalena Giral following a verbal altercation he got into with another employee at the site, Rogelio Figueroa-Aviles, the affidavit stated.

At approximately 5:07 p.m., Austin Police responded to 4500 S. Pleasant Valley Road for reports of a disturbance. The location was monitored by both Figueroa-Aviles and Giral, who were in charge of ensuring delivery trucks activities were in compliance with the City of Austin.

The affidavit stated that Figueroa-Aviles advised Medina to clean mud off of his truck so that he would not leave debris on the public roads after he vacated the premise.

According to the affidavit, Medina was cleaning the waste off of the truck’s tires with a stick, but became frustrated with the task and thew the object at Giral’s feet. Medina's actions prompted Figueroa-Aviles to take photos of Medina’s truck and its license plates with the intentions of reporting the truck to his supervisors, according to police reports.

Medina responded with obscenities, and then retrieved a handgun from the cab of his truck and dared Figueroa-Aviles to take another picture, according to the affidavit. Upon spotting the weapon, Figueroa-Aviles fled the scene in fear of being shot, leaving Magdalena behind, police said.

Medina proceeded to point the firearm at Magdalena for around 10 seconds, however, he left the scene in his truck shortly thereafter without harming anyone.

The photos captured by Figueroa-Aviles helped police identify Medina as well as the dump truck, which was registered to Cubmex Trucking. The company confirmed their ownership of the blue and white dump truck and was able to identify Medina to police.
