Crispin Harmel, a man accused of strangling Jessika Kalaher back in 2009, can be retried, according to the Texas Third Court of Appeals on Wednesday.
Harmel's case ended in a mistrial when the judge ruled that prosecutors did not share evidence with the defense. KVUE's news partners at the Austin American-Statesman report that the court of appeals ruled he will not face double jeopardy -- being prosecuted for the same offense -- if he is tried again.
Williamson County District Attorney Jana Duty spent a few days in jail back in August 2015 for violating a gag order in the case.
