AUSTIN, Texas — A 22-year-old man has been accused of sexually assaulting a 13-year-old girl after offering her a place to stay in Austin, police said.
According to an affidavit, police responded to a call regarding a missing girl on Jan. 9.
When police arrived at the residence, the grandmother of a 13-year-old girl said her granddaughter had just returned home from running away.
While speaking with police, the girl began to cry as she told officers how she was allegedly sexually assaulted after running away.
The victim said she had left school and went to a nearby gas station, hoping to run into a friend that would be willing to let her stay the night, according to the affidavit.
Police said the victim explained how her friend was not working at the time, but referred her to a co-worker that goes by the name of "Trey," later identified as Walter James, who turned 23-years-old since the incident occurred.
According to police, James let the victim know that she could stay the night at his residence.

The victim told police she made it clear to James that she would not be sleeping with him in his bedroom, and that she would be sleeping on a couch.
According to the affidavit, the two exchanged their ages with James, saying he was 22-years-old and the victim saying she was 13-years-old.
The victim reportedly told police James took her to his vehicle as they approached his residence, left her in the vehicle and said he would return in a short while.
The victim said James returned later and raped her, according to the affidavit.
The victim was given a sexual assault exam and she explained to a nurse who sexually assaulted her, according to police.
Police said based off of their investigation, they do believe James sexually assaulted the victim.
According to online records, James is not in police custody as of Wednesday afternoon.
