AUSTIN — The man accused of stabbing 32-year-old Daniel Spencer to death back in September of 2015 was found guilty of criminally negligent homicide, according to a court coordinator in the 450th District Court.
And Wednesday, James Robert Miller Jr. found out that he will serve 10 years of probation. He also must serve six months, or 180 days, in jail.
He was eligible for probation because he's never been convicted of a felony before, KVUE's partners at the Austin American-Statesman reported.
Miller was charged with murder after he turned himself into the police in 2015 and told an officer, "I think I killed someone... I stabbed him."

According to the arrest document for Miller, he was invited to Spencer's house to play music. Police said Miller told Spencer, "Hey, I'm not gay ... We're musicians and all that kind of stuff but I'm not a gay guy."
Miller continued to tell police, "Then it seemed like everything was alright and everything was fine. When I got ready to go -- it seemed like [stuff] just started happening," the affidavit said.
When police arrived, they found Spencer's body on the floor.
