Austin man who shoved, killed man he said groped his wife in 2016 found not guilty, officials say

The victim died from head injuries days after the shove.

AUSTIN — Spencer Carlton, the Austin man who shoved and killed a man on Sixth Street who he said had groped his wife in 2016, was found not guilty of criminally negligent homicide, officials said.

The trial, which began May 29, came after police said Carlton pushed Jerry Don Summers outside of The Dogwood bar on West Sixth Street and West Avenue on March 15, 2016. Summers died from head injuries days later. Carlton was initially charged with manslaughter, but he was later charged with criminal negligent homicide, a state jail felony that includes a maximum punishment of two years.

The clerk for the 167th District Court said the verdict was made May 31.
