Elon Musk's Boring Company handed a new violation

A Bastrop resident filed a complaint with the Texas Commission on Environmental Equality (TCEQ) that indicated Boring was tunneling without a permit.

BASTROP, Texas — Elon Musk's The Boring Company is once again in hot water after it was hit with a new violation from the Texas Commission on Environmental Equality (TCEQ).

Chap Ambrose, a Bastrop resident who has raised concerns about how the tunneling company operates, filed the complaint with TCEQ in April after claiming The Boring Company constructed a tunnel at the Gigafactory in Austin without a permit. 

"Their whole goal is to build public infrastructure for us. And if they can't do the basics right, I think they're going to have an uphill battle" Ambrose said.

TCEQ conducted the investigation on April 29. Ambrose provided KVUE with the report that read, "Grout and Soil Stabilization Silos were observed to have been installed before authorization had been received from the TCEQ Air Permits Division," and requested the proper documentation be submitted.

KVUE reached out to TCEQ on Wednesday. A spokesperson provided the following statement:

"The TCEQ Austin Region conducted an investigation on April 29, 2024 from a complaint about tunneling being conducted by the Boring Company at the Cyber Tunnel facility in Austin, Texas. Silos and conveyors were observed at the location that tunneling was occurring. A violation was alleged for failure to obtain authorization prior to constructing a facility that emits air contaminants. The Boring Company submitted an application for the portable soil stabilization plant and the registration was approved by TCEQ on June 12, 2024, thereby resolving the violation prior to the issuance of the Notice of Violation that was mailed on June 28, 2024."

Ambrose said despite the resolution, he believes the matter is something the state should pay attention to. He also said that he, along with other Bastrop residents, will continue to sound the alarms so long as he sees company not following state requirements. 

"We continue to see repeat issues," Ambrose said. "I just don't trust this company, and this leadership team to get it done safely."

This isn't the first time The Boring Company has been hit with violations. Last month, the company was issued a fine of $11,876 that mostly dealt with the company's construction activity. 

KVUE reached out to The Boring Company, but we did not receive a response at the time of publication.
