Family of late San Marcos fire victim files lawsuit against apartment complex

This new lawsuit comes after two others were filed against the San Marcos complex. The other lawsuits claim the fire alarms "failed to effectively activate to warn all residents."

SAN MARCOS, Texas — Another lawsuit has been filed against the San Marcos apartment complex that claimed the lives of five victims and left more than 200 others without a home after a deadly fire ignited in July.

The family of late victim Dru Estes filed a lawsuit against the Iconic Village apartments Friday claiming gross negligence. The lawsuit claims that as the fire spread, the fire alarms in the complex did not go off.

This comes after two other lawsuits were filed against the complex. The other lawsuits also claim the fire alarms "failed to effectively activate to warn all residents."

Estes, who was only 20 years old, was one of five victims who died in the fire on July 20. The other fatal victims include Haley Michele Frizzell, David Ortiz, James Miranda and Belinda Moats.
