Judge in Kelley case recuses himself from new trial request

GEORGETOWN -- The judge who presided over the trial of Greg Kelley in July recused himself from considering Kelley's motion for a new trial Monday.

District Judge Billy Ray Stubblefield sent a letter to the chief justice of the Texas Supreme Court asking for another judge to consider the motion for a new trial.

"The interests of justice would be served by having another judge consider the Defendant's Motion for New Trial and the State's response thereto with fresh eyes and ears," said the letter.

Earlier this month, Greg Kelley's attorney filed a formal response to request for a new trial.

Kelley was convicted of sexual assault on July 16. He was sentenced to 25 years in prison without parole. Kelley will serve two 25-year sentences concurrently with no possibility of parole and no right to appeal. He will also be required to register as a sex offender.
