AUSTIN, Texas — A man has been arrested and charged with first-degree murder following a deadly shooting on Monday evening in northwest Austin.
The Austin Police Department (APD) said just before 6 p.m. on April 22, officers responded to reports of shots fired at 11215 Research Blvd. One of the callers said they saw a man running and shooting, while another caller said someone had been shot near the back of an apartment complex. A third caller said they had seen someone get shot near an H-E-B, APD said.
Officers arrived on the scene and found a man, later identified as 35-year-old Jose Rubio, with gunshot wounds at the intersection of U.S. 183 southbound and Balcones Woods Drive. Rubio was pronounced dead on the scene.
Officers learned that a second shooting victim, identified as David Cerda-Funes, was dropped off at a local hospital by a woman driving a Chevrolet Tahoe. The woman immediately left the emergency room after dropping the man off, police said.
The Tahoe was later located in the parking lot of the hospital with 29-year-old Javier Vega-Funes inside. Vega-Funes reportedly tried to flee on foot but was detained by officers. Cerda-Funes was identified as Vega-Funes' brother.
APD said Rubio shot Cerda-Funes at 11215 Research Blvd. before leaving on foot. Vega-Funes then helped his brother into the Tahoe and left the apartment to catch up with Rubio while he was still on foot.
Vega-Funes allegedly got out of the Tahoe and shot Rubio on the southbound frontage road of U.S. 183 at the Balcones Woods Drive intersection.
Vega-Funes has been charged with first-degree murder in connection with the shooting.
Cerda-Funes remains in the hospital in a critical condition.
The case is being investigated as Austin’s 16th homicide of 2024.
