WILLIAMSON COUNTY -- The Williamson County District Attorney's Office filed its formal response Monday to a request for a new trial by convicted sex offender Gregory Kelley's attorney.
The 18 page document is intended to convince the original trial judge that Kelley does not deserve another shot at freedom.
It said Kelley's attorney's motion, "...alleges no new evidence, let alone facts, that could support the defendant's bare claims of innocence."
In response to a juror affidavit brought forward by the defense, claiming he was pressured into voting guilty, Assistant District Attorney Geoffrey Puryear wrote, "…each juror individually announced in open court their guilty verdicts."
Kelley's new lawyer filed for a new trial after Kelley waived his right to appeal in exchange for 25 years in prison.
A judge has until the end of September to decide whether or not to grant Kelley a new trial.
Kelley was convicted of sexual assault on July 16. He was sentenced to 25 years in prison without parole. Kelley will serve two 25-year sentences concurrently with no possibility of parole and no right to appeal. He will also be required to register as a sex offender.
