Suspect in death of Hutto sergeant not charged with capital murder yet

HUTTO, Texas – The 26-year-old man allegedly involved in the death of a Hutto police sergeant back in June has not received capital murder charges yet as of July 13.

According to Mark Brunner with the Williamson County District Attorney's Office, the grand jury will be looking at possible capital murder charges over the next couple of months. The incident is still an active investigation.

According to arrest documents, Colby Ray Williamson struck Hutto Police Sgt. Chris Kelley with his vehicle after a traffic stop and struggle on June 24.

Hutto peace officers attempted to stop Williamson's vehicle on Herrera Trail in Hutto when he allegedly fled in his vehicle. Williamson was involved in a collision, and then he fled on foot.

Kelley attempted to apprehend Williamson on Wren Cove near the intersection of FM 1660 and Meadow Lark Lane around 10 a.m. Wednesday when the two engaged in a struggle. When two other responding sergeants arrived, they saw Kelley's vehicle traveling in reverse with its driver-side door open, according to the document. It states that the officers saw Kelley struggling with Williamson in the front seat. Then, an officer saw Kelley "fall from the open driver side door and saw the vehicle run over his body."

The responding officer saw the vehicle being driven away by Williamson. One of the officers tried to help Kelley while the other pursued Williamson down Decker Drive, the affidavit states. At the intersection of Creek Lodge Drive, Williamson jumped out of the patrol car and ran on foot. The officer continued to pursue him in his vehicle, and then apprehended him on foot.

Williamson was taken into custody by Hutto police and booked into the Williamson County Jail.

Jail records show he was behind bars on a charge of aggravated assault with a deadly weapon on a public servant.
