Court documents reveal how a man with Austin ties ended up on a Texas most wanted list

AUSTIN, Texas — Warning: Some readers may find the following details disturbing.

Court documents reveal how a man with ties to the Austin area ended up as a wanted fugitive in Texas.

Fabian Martinez Toribio, 25, was recently placed on the Texas 10 Most Wanted Criminal Illegal Immigrants list, which was launched in June by Gov. Greg Abbott.

According to an affidavit obtained by KVUE, Martinez Toribio was being investigated by the Austin Police Department (APD) for sexual and physical offenses committed against children.

During an investigation in January, police said they received a call from a woman who believed her 5-year-old daughter had been raped by her stepfather.

The woman told police she found a mark on her daughter's neck and asked where it came from, but that her daughter did not answer. She then asked the suspect, later identified as Martinez Toribio, to leave the room. Police said he refused until the woman physically pushed her out.

The 5-year-old then allegedly said her stepfather took her pants off and touched her inappropriately before stealing her underwear. Martinez Toribio fled from the house after the woman called police to report the incident.

While authorities examined the 5-year-old for injuries, they found multiple bruises on her neck. She also identified Martinez Toribio as the suspect and claimed that he told her not to tell her mother.

During another interview with authorities, the 5-year-old accused Martinez Toribio of exposing himself to her before touching her inappropriately. Her mother tried to contact the man but never received a response.

Toribio Martinez has been charged with super aggravated sexual assault following the alleged incident. His whereabouts remain unknown.
