SAN MARCOS, Texas — San Marcos police have a man in custody after a fatal hit-and-run on July 14.

The city of San Marcos said 35-year-old Emmanuel Nicholas Martinez of Seguin turned himself in on July 24. He has been charged with Collision Involving Death and Intoxication Manslaughter with Vehicle. His bond has been set at $50,000 for each charge.

According to police, the two-vehicle crash happened at approximately 5:40 a.m. on July 14 on Interstate 35 northbound, towards Exit 208. A driver and four passengers were reportedly heading to Irving, Texas, from Mexico in a black SUV when they were hit by a white Toyota minivan.

Police said the SUV crashed into the exit sign before rolling over, and the driver was ejected from her seat. She later died at Ascension Seton Hays hospital in Kyle. The remaining four passengers suffered non-life-threatening injuries.

During the incident, an off-duty trooper allegedly saw Martinez flee the scene in the minivan before crashing into a dumpster and running away to an apartment near FM 110.
