BUDA, Texas — Bad-smelling stuff on your property could end up costing you up to $500 in Buda.

On Tuesday, the city council passed an expansion to its odor nuisance ordinance.

The smell must be unreasonably bad – it has to "adversely impact public welfare, property values, the economy or quality of life."

The city listed chemicals, composting and stagnant pools and dead animals as examples.

It's a misdemeanor if someone is found guilty of violating the ordinance.

The ordinance applies to an area within the city limits and 5,000 feet outside city limits.

Offensive odors include, but are not limited to:

  • Chemicals. Offensive odors from the use or possession of chemicals or from industrial processes or activities which shall disturb the comfort and repose of persons of ordinary sensibilities.
  • Smoke. Offensive odors from smoke from the burning of rubbish, trash, rubber, chemical substances or other things or substances which shall disturb the comfort and repose of persons of ordinary sensibilities.
  • Stagnant pools, refuse, and composting. Offensive odors from stagnant pools, rotting garbage, refuse, offal, or composting which shall disturb the comfort and repose of persons with ordinary sensibilities.
  • Dead Animals. Offensive odors from dead animals which shall disturb the comfort and repose of persons with ordinary sensibilities.
