New details released as police identify man shot, killed by officers in North Austin

According to police, 59-year-old Franklin Earl Miller died following a standoff at a shopping center on West Anderson Lane on Sept. 10.

AUSTIN, Texas — A man shot to death by multiple officers in North Austin has been identified.

According to the Austin Police Department (APD), 59-year-old Franklin Earl Miller died following a standoff at a shopping center on West Anderson Lane on Sept. 10.

An ongoing investigation into the shooting revealed that five officers used their firearms on Miller, while a sixth used a less-lethal "pepperball" launcher at the same time.

APD said the officers who fired their weapons have been with the department ranging from four months to more than six years of service. The incident was captured on bodycam footage, which will be released within 10 business days.

What led up to the shooting?

Police said they received a top priority "prowler" call about a man trying to break into a business. The caller told officers he was armed with a rock and may have had a gun in his waistband.

When officers arrived, they said Miller did not comply with their commands. Immediately after, Miller placed his hands near his waistband and held onto an object, which appeared to be his pistol. Officers told Miller to put his hands up, but he continued to disobey.

During the standoff, police said Miller continued making exaggerated movements as officers tried to de-escalate the situation. After 14 minutes, police said Miller raised the gun he was holding in the direction of officers, which led them to open fire. Despite life-saving measures, Miller died at the scene.

No one else was injured in the incident. Two concurrent investigations into the incident are ongoing.

Police initially said five officers involved were placed on administrative leave, per department policy. On Tuesday, Sept. 17, APD confirmed that all six officers are on administrative duty.
